Processing of personal data

We understand that your trust in us is the most important asset of 4INCH SA (hereinafter referred to as ‘4INCH’, ‘we’ or ‘us’). Your privacy is therefore of the utmost importance to us. This privacy statement (hereinafter referred to as the ‘Privacy Statement’) applies, inter alia, to (i) our websites www.4inch.be, www.snugr.be and any sub-domains of these websites (hereinafter referred to as the ‘Website’), (ii) visits to our offices and (iii) all (commercial) relationships between 4INCH and its customers, prospects and business partners.

This Privacy Statement contains, among other things, information about the personal data that 4INCH collects and how 4INCH uses and processes such personal data.

4INCH wishes to emphasise that it tries at all times to act in compliance with (i) the Belgian law the Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data (Privacy Law) (for as long as it is in force), with (ii) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (iii) all (future) Belgian laws concerning the implementation of this Regulation.

Visiting the website, creating a demo account with a view to using the Snugr demo (the solution marketed by 4INCH), creating an account with a view to using the 4INCH or Snugr services, registering for the newsletter and/or a seminar, online seminar or event, implies your express consent (by providing your personal data or ‘opt-in’ to participate) to the Privacy Statement and therefore to the way in which we collect, use and process your personal data.

Types of personal data

4INCH may collect and process the following personal data:

• Last name
• First name
• Job title
• Company (or home) address
• Invoice address
• E-mail address
• Telephone number (landline/gsm)
• User name
• Your password
• Company name
• Information about your use of the Website, the 4INCH platform, Snugr, (hereinafter referred to as the ‘Platform’) (such as, but not limited to, IP address, browser type, operating system)
• Connection data from your mobile device, as well as geographical location data (if applicable)
• Measurement data, schedules (and any other data necessary) for the operation of the Snugr solution
• Your communication preference
• Any personal data voluntarily provided to 4INCH (e.g. correspondence data between you and 4INCH).

4INCH also automatically collects anonymous information about your use of the Website and 4INCH services via the Platform. For example, 4INCH will automatically record which parts of the website or Platform you visit, which web browser you use and which website you were visiting when you received access to the website. We cannot identify you on the basis of this data, but it does allow 4INCH to compile statistics about the use of the Website or Platform.

Method of collection of personal data

This personal data is collected in the event of or in the context of:

• Download the templates
• Visit the website
• Visit the 4INCH offices
• Your use of 4INCH's services, whether or not via the website, or the Platformi, and/or whether or not via a mobile device

• Verification of your identity (e.g. when using customer service)
• Correspondence with and from 4INCH
• Communicating to 4INCH ideas for improving the services or the Platform.

The personal data collected by 4INCH is therefore expressly and voluntarily provided by you.

Use of personal data

4INCH may use your personal data for the following purposes:

• registering visitors when they visit the 4INCH offices
• Creation of a demo account and confirmation of this creation
• Fulfilment of the agreement with 4INCH (including follow-up)
• The provision of 4INCH's services whether or not by means of the Website, or the Platform, and/or whether or not via a mobile device
• The provision of support/assistance (e.g. in the event of a problem)
• Sending targeted marketing notices and advertisements, updates and promotional offers based on your communication preference and, where applicable, with your explicit consent
• Sending invoices and collecting payments
• Optimising the quality, management and content of the website or Platform
• Creating statistics
• Developing an offer
• Carrying out research, customer satisfaction surveys and other market studies

Processing takes place for the following legal reasons, as applicable:

• You have given your consent to the processing of your personal data for one or more specific purposes
• Processing is necessary for the performance of the agreement with 4INCH or in order to take action at your request before entering into an agreement
• Processing is necessary to comply with a legal obligation to which 4INCH is subject
• Processing is necessary in order to protect your vital interests or those of another natural person
• Processing is necessary for the performance of a task carried out in the public interest
• Processing is necessary for the purposes of the legitimate interests pursued by 4INCH or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject, which require the protection of personal data (in particular if you are a child).

Disclosure of personal data to third parties

4INCH will not disclose your personal data to third parties, except where necessary in connection with the provision of 4INCH's services and their optimization (such as, but not limited to, maintenance work, payment processing, provision of services to 4INCH (e.g., outsourcing, database management). In this respect, your personal data may be disclosed to payment service providers, software providers, cloud partners, data centres, external IT consultants and service providers.

If it is necessary for 4INCH to disclose your personal data to third parties in this context, the third party concerned will be obliged to use your personal data in accordance with the provisions of this Privacy Statement.

Notwithstanding the foregoing, 4INCH may disclose your personal data:

• To the competent authorities (i) where 4INCH is required to do so by law or in connection with legal proceedings or prospective legal proceedings and (ii) to secure and defend our rights;
• Where 4INCH or substantially all of its assets are taken over by a third party, in which case your personal data - which 4INCH has collected - will be one of the transferred assets;
• For the purpose of detecting profiles similar to yours, except where you have expressly objected to this.

In all other cases, 4INCH will not sell, rent or transfer your personal data to third parties, except when it (i) has obtained your consent in this respect and (ii) has entered into a data processing contract with the third party concerned, which contains the necessary guarantees regarding confidentiality and compliance of your personal data with the protection of your privacy.

Storage of personal data 

Except where a longer retention period is required or justified (i) by law or (ii) by compliance with another legal obligation, 4INCH will retain your personal data only for as long as is necessary to achieve and fulfil the purposes as described in the Privacy Statement, under the heading ‘use of personal data’.

Your privacy rights

In connection with the processing of your personal data, you have the following privacy rights:

• Right of access to personal data that 4INCH may hold about you;
• Right to rectify, complete or update your personal data;
• Right to delete your personal data (‘right to be forgotten’) (4INCH wishes to point out that in this context certain services will no longer be accessible and/or can no longer be provided if you delete or request the deletion of certain required personal data);
• The right to limit the processing of your personal data;
• Right to the transferability of your personal data;
• Right to object to the processing of your personal data.

Protection of personal data

4INCH undertakes to take reasonable physical, technological and organisational precautions to prevent (i) unauthorised access to your personal data and (ii) loss, misuse or alteration of your personal data.

4INCH will store all personal data it has collected in the cloud (with data centre(s) located in the EU).

Notwithstanding 4INCH's security policy, controls and actions, an infallible level of security cannot be guaranteed. No method of transfer or transmission via the Internet, nor any method of electronic storage, is 100% secure, so that 4INCH cannot, in this context, guarantee absolute security.

Finally, the security of your (demo) account will also depend on the confidentiality of your password for receiving access to the Platform. 4INCH will never ask you for your password, so you are obliged not to disclose it yourself. If you have nevertheless disclosed your password to a third party - e.g. because that third party has indicated that it offers you additional services - that third party will receive access, via your password, to your (demo) account and your personal data. In this case, you yourself are responsible for the actions that result from the use of your (demo) account. 4INCH therefore strongly advises you, if you become aware that someone has gained access to your (demo) account, to change your password immediately and to contact us.

Cross-border processing of personal data

Any transfer of personal data outside the European Economic Area (EEA) to a recipient that has its domicile or registered office in a country that does not fall under an adequacy decision, promulgated by the European Commission, will be governed by the provisions of a data transfer agreement, which will contain (i) the standard contractual clauses as defined in the ‘Decision of the European Commission of 5 February 2010 (Decision 2010/87/EC)’, or (ii) any other mechanism on the basis of privacy legislation or any other regulation relating to the processing of personal data.

Snugr Products

Snugr controller box

Communicates by radio with the valves and boiler control box. Learns when to start and stop heating each of your rooms. Connected via network cable to your modem so you can manage your heating system from anywhere with a computer, tablet or smartphone. Powered by micro-USB cable (provided).

Boiler box

Starts up the boiler when a room needs heating and shuts it down when all rooms have reached the desired temperature. Can replace your existing thermostat depending on your boiler set-up, but doesn’t have to for Snugr to work properly. Requires a dry contact. Takes two AA batteries (average battery life: two years).

Snugr Easypelt radiator valve

Easy to install, motorised and fitted with a temperature sensor. Communicates by radio (EnOcean Protocol) with the Snugr box to maintain the right temperature at the right time in each room. Replaces your existing thermostatic valves and does not require any major work. Does not require batteries thanks to the Seebeck effect (opposite of the Peltier effect). Reduces the building maintenance.

The unit heater / circulator box

This box has a relay to control the start or stop of one (or more) unit heater(s) when combined with a temperature sensor, a circulator or any other device requiring more control power. Power supply via 230VAC. Communicates via radio waves with the central box.

Snugr Smart Plug

To be placed in an existing power outlet, this Snugr Smart Plug controls the power of a direct electrical heater up to a power of 11 A (around 2500W of heating power). As it is often placed next to the floor, it does not content a temperature sensor and must be combined to a Snugr temperature sensor (one by room).

Options

Switch

Easy to install. Allows you to activate the heating in a room at a predefined temperature and for a predefined time without having to access the management interface. Ideal for a meeting room or hotel room for example. Operates without batteries and communicates by radio with the Snugr box.

Temperature sensor

Easy to install. Works with or without battery. Communicates by radio with the Snugr box to measure the temperature in another part of the room where measurement at the valve is not recommended. Runs for up to four days fully charged, up to 4 years with battery (CR1216, in option).

Open-window detector

Easy to install. No need for batteries. Communicates by radio with the Snugr box to detect open windows or doors and prevents unnecessary heating. Runs for up to four days fully charged, up to 4 years with battery.
